VERDICT: Former Delaware County Emergency Services Director Guilty of Indecent Assaults of 2 Employees on the Job

HARRISBURG — Attorney General Dave Sunday announced that the former director of Delaware County Emergency Services was convicted Friday of indecent assault and harassment regarding incidents with two former employees.

A Delaware County jury convicted 63-year-old Timothy A. Boyce of four misdemeanors — two counts each of indecent assault and harassment — following four days of testimony. He will be sentenced on Dec. 18.

According to testimony, in separate incidents, Boyce grabbed the employees in private areas and kissed one employee without consent. He also repeatedly made lewd comments.

When one victim who testified was asked why she didn’t report the assault immediately, she replied, “Who do you call when the person in charge of 911 assaulted you? Who do you trust?”

At the verdict, prosecutors requested that bail be set. The judge set bail at $50,000, and Boyce was taken into custody.

“This is egregious conduct from a person who was entrusted to lead a team of emergency responders,” Attorney General Sunday said. “I commend the investigators, prosecutors, and jurors for making it clear that job title and status are not exemptions from being held accountable for criminal conduct.”

The Delaware County District Attorney’s Office referred the case to the Office of Attorney General.

The case was prosecuted by Deputy Attorney General Madelyn Abry.
